Sixth Circuit voids $31.8 million cannabis contract award

The Sixth Circuit reversed a $31.8 million jury award because federal courts cannot enforce a supply agreement requiring federally illegal marijuana transactions, and it said the 2026 medical rescheduling change did not retroactively cure the contract. Oklahoma cannabis businesses should revisit forum selection, arbitration and remedy provisions instead of assuming a federal court will enforce state-legal deals.
